12 名前任現任大律師公會主席:遺憾政府硬推修例 政府指「法官把關」實屬誤導
包括戴啟思、陳景生、石永泰等香港大律師公會的現任和前任主席,對政府一意孤行推行《逃犯條例》感到十分遺憾,又提出政府指「法官把關」實屬誤導說法。

12名大律師公會前任及現任主席包括李柱銘、張健利、羅傑志、梁冰濂、黃福鑫、李志喜、余若薇、梁家傑、陳景生、戴啟思、林孟達和石永泰,參與聯署。同樣曾任大律師公會主席的前律政司司長袁國強、行政會議成員湯家驊、譚允芝、林定國,則未有參與聯署。

聲明擔心,目前香港與其他地區簽訂引渡協議,互相移送被告人,一旦修訂《逃犯條例》獲通過,便會繞過這些傳統保障。他們認為,根據特區政府的修例建議,將來只要特首一紙證明,便可啓動引渡或移交程序,將被告送到一個未能提供符合《世界人權宣言》或《公民權利和政治權利國際公約》國際標準的權利保障的地區受審,整個決定過程中,香港立法會並無角色可言。

聲明反駁政府所指香港法官會把關,修例後不會任意移交被告人,「但現時法庭審理引渡申請時,無權考慮提出申請的地方是甚麼法律制度和程序,修訂《逃犯條例》不會改變法官這權限。因此,所謂『法官把關』實屬誤導說法。」

坊間有多個建議方案可處理陳同佳台灣殺人案,聲明對此同樣感到遺憾。聲明指出,域外管轄權是一個可取方案,授權香港法庭審理在外地犯謀殺罪的港人,「我們必須嚴正明確地說明,這安排並不抵觸普通法的精神和原則。英國早已訂立《1861年侵害人身罪法令》,賦與英國法院審理英國人在外地犯謀殺罪的域外管轄權 。香港法院審理修例前的兇殺案,也不違反保障人權的原則,因為謀殺在香港從來都是罪行。」

聲明全文如下:

我們都是香港大律師公會的現任和前任主席,對於政府沒有做好恰當的諮詢便硬要通過修訂《逃犯條例》,如此一意孤行,我們感到十分遺憾。

目前香港與其他地區簽訂引渡協議,互相移送被告人,必須先確定這些地區的刑事法律制度可與香港兼容,程序公平程度可媲美香港。一旦修訂《逃犯條例》,就會繞過這些傳統保障。根據特區政府的修例建議,將來只要特首一紙證明,便可啓動引渡或移交程序,將被告送到要求引渡地區受審,被告可能不得享有符合《世界人權宣言》或《公民權利和政治權利國際公約》國際標準所列的人權保障。整個決定過程中,香港立法會並無角色,不容置喙。

特區政府一再強調,修例之後不會任意移交被告人,因為香港法官會把關。但現時法庭審理引渡申請時,無權考慮提出申請的地方是甚麼法律制度和程序,修訂《逃犯條例》不會改變法官這權限。因此,所謂「法官把關」實屬誤導說法。

We are the current and former Chairmen of the Hong Kong Bar Association and are dismayed to note the Government’s insistence on pushing through the amendment to the Fugitive Offenders Ordinance without a proper consultation.

If implemented, the proposed new legislation will circumvent the traditional safeguard that extradition and rendition proceedings will only be available in respect of jurisdictions where the criminal legal system and procedure has previously been determined to be compatible with and of a fairness comparable to that of Hong Kong. What is proposed is that a simple statement by the Chief Executive without any ability of scrutiny by the Legislature will suffice to set in motion extradition or rendition proceedings to a jurisdiction where the rights of the defendant may not be of internationally accepted standards under the Universal Declaration of Human Rights or the International Covenant on Civil and Political Rights.

The oft-repeated assertion that the Judges will be gatekeepers is misleading. It is not, and never has been, the function of the Courts in considering an application for committal for extradition or rendition to consider the legal system and procedure of the foreign jurisdiction. The proposed new legislation does not give the Court power to review such matters and the Court would be in no position to do so.

We are also dismayed to note the recent rejection by the Secretary for Justice of all the alternative proposals put forward by many to resolve the Taiwan murder case. We wish to state categorically that it is not against the spirit and principles of common law to give Hong Kong extraterritorial jurisdiction on serious offences like Murder. Indeed the United Kingdom has such jurisdiction in its Offences Against the Person Act in 1861. It is also not incompatible with the protection of human rights to try such person for murder previously committed as murder has always been an offence in Hong Kong.
