【香港民族黨就中國政府今日對「基本法」的「解釋」向香港法院之呼籲】
中國政府今日草率對「基本法」作出「解釋」，試圖規限香港法院審理相關案件時之權力，可謂香港開埠以來司法制度首宗未審先判之例，足見被中國竊據主權之香港，連司法獨立也難以維持。
香港司法制度得賴英國普通法憲制，權力分立和司法獨立的憲制原則由比香港開埠要早過百年的英國憲制文件確立。香港法院身為香港司法制度的核心，有義務捍衛普通法的制度和憲制，阻止其崩壞於中國人之手。
因此，香港民族黨現呼籲香港法院：
1. 以普通法原則、考慮「基本法」第一百五十九條對修法之規定，宣佈中華人民共和國全國人民代表大會常務委員會根據「基本法」第一百五十八條對「基本法」條文一切有違普通法原則下之「解釋」屬越權及無效；及
2. 如審理相關案件之法官拒絕以普通法原則理解「基本法」第一百五十八條，則香港法院屬捍衛普通法制度及司法獨立不力，所有審理相關案件之法官及終審法院之全體法官應引咎辭職。
【HKNP's appeals towards the Court of Hong Kong in relation to today's "interpretation" of the "Basic Law" by the colonial Chinese government】
The colonial Chinese government has recklessly made an "interpretation" of the "Basic Law" in an attempt to restrict the court's power in ruling on relevant cases. This is the first time since the establishment of Hong Kong in the 1840s that the judiciary faces a case of decision before trial, evidencing the fact that under illegitimate Chinese sovereignty even judicial independence cannot be maintained in Hong Kong.
Nourished by the English common law constitution, the judiciary of Hong Kong is founded upon separation of power and judicial independence, principles established more than a hundred years before the beginning of British sovereignty over Hong Kong. Being the core of the judiciary, the Court of Hong Kong has a duty to uphold the common law institution and constitution against Chinese interference.
In light of the above, Hong Kong National Party hereby makes the following appeals to the Court of Hong Kong:
1. to interpret article 158 of the "Basic Law" in accordance with common law principles of interpretation, in particular consideration of article 159 of the same, and accordingly declare that any "interpretation" made by the Standing Committee of the National People's Congress of the People's Republic of China which contravenes the common law principle of interpretation be ultra vires and thus invalid; and
2. in the event that the judge(s) before the relevant cases refuses to make the above declaration, the judge(s) and all judges of the Court of Final Appeal to resign, for the reason of incapable to defend the common law institution and judicial independence.
