【本土民主前線早前去信英國外相夏文達】
2016年1月21日, 本土民主前線以空郵方式寄信給英國外相夏文達,交代桂民海「自首」影片的疑點及講述李波失蹤的狀況,指出夏文達早前擔憂的「【極嚴重】違反一國兩制、《基本法》和《中英聯合聲明》」已經發生,亦要求英國調查銅鑼灣書店五人的失蹤事件。

本土民主前線最後寄語英國政府勿忘《中英聯合聲明》中保障香港司法獨立不受干預。

本土民主前線明白身為香港一個細小的組織,近乎沒可能得到英國政府的正式回覆,但我們明白《中英聯合聲明》為香港與中共於國際社會間博奕的重大籌碼,而主流政黨常常懼怕於中共指控「勾結外國勢力」而不敢主動聯絡外國努力為港人爭取最大籌碼,故本土民主前線向英國外相寄出此信件。

雖然英國政府最終沒有直接回覆本組織,惟在英國外相報告中亦指李波被「非自願移送」,內地嚴重違反《聯合聲明》,與本組織去信的原意一樣,故本組織亦借此機會感謝英國開始調查銅鑼灣書店五人的失蹤事件。

Dear Mr. Philip Hammond,

We are writing for a request to investigate the whereabouts of five booksellers of a Hong Kong bookstore which sells mainly books critical of the CCP.

Hong Kong Indigenous (H.K.I) is an organisation that was established in 2015, shortly after the Umbrella Revolution in 2014, by young protesters who are localists and strive to resist the erosion of Hong Kong from the Chinese government and safeguard Hong Kong’s core values.

Mr. Lee is the only person with national citizenship of the United Kingdom. However, we believe that the information and whereabouts of the missing five should be considered with equal importance and urgency as the reason of their disappearance is the same. China’s state TV channel, CCTV has recently broadcast a “confession” of one of the booksellers, Mr. Gui Minhai(桂民海). Many foreign press have quoted China’s official information, which may be misleading. Even though Gui Minhai is not a citizen of the UK, the following facts and questions should be raised:

1) It is clear that the video has been edited as Mr. Gui’s hairstyle, outfit, mental status and even the background lighting are obviously different.

2) Mr. Gui described that he made the voluntary decision to return to China to face charges related to a car accident in 2003. CCTV has reported that Mr. Gui was 46 years old at the time but he was born in May 1964, making him 39 years old in 2003. The Chinese name of the driver in the crash is 桂敏海 instead of 桂民海, which is a difference of one character.

According to the video, Mr. Gui went to the police voluntarily but he did not admit to what crime he had committed. Furthermore, the driver at the accident was sentenced to a two-year suspended prison sentence. There is no motive for him to run away given that he did not need to go to prison.

Mr. Gui’s daughter, currently in the UK, still holds the firm belief that her father was kidnapped because of his business. In the video, Mr. Gui asked the Swedish authority to respect his personal choice, rights and privacy and let him solve his own problems despite the fact that he is a Swedish national. He also made the claim that ‘I truly feel that I am still Chinese and my roots are still in China’. The authenticity of the video is highly suspicious, and a question remains over whether Mr. Gui was coerced into his confession. This has exposed the Chinese government’s efforts to spurn all foreign governments instead of clarifying the charges of Mr. Gui and whether he went to China voluntarily or whether he was forced into doing so.

At the time of writing, Chinese police has confirmed Mr. Lee is within mainland China’s border as of the 20th day of his disappearance. In addition to the fax from Mr. Lee to his wife, it is assumed that this is another script for Mr. Lee will be published by CCP soon. We truly hope that the UK authorities do not buy into such misleading information, which may include Mr. Lee rejecting the assistance of the UK government.

Furthermore, there were witnesses claiming that Mr. Lee was forced into a van by several individuals on 30 Dec 2015 in an industrial building in Hong Kong. Combined with Mr. Lee's fax claiming he is in China to help the investigation and the confirmation from China's police that he is in China's border. It is evident that China has severely interfered in Hong Kong's freedom of press and violated Hong Kong's legal autonomy no matter Li was kidnapped by Chinese police or through other outlaws. Clearly, an egregious breach of the principle of ‘one country, two systems’, the Basic Law and the Sino-British Joint Declaration has happened, as addressed concernedly by your good self.

We request the assistance from The United Kingdom of Great Britain and Northern Ireland to investigate the missing of Mr. Li and Mr. Gui and the other three, who should be protected by the Sino-British Joint Declaration.

We urge you to recall the commitments set out by both Britain and China at the handover in 1997,that the Sino-British JD protects Hong Kong’s legal autonomy, Lee, Gui and others are in Hong Kong and under Hong Kong’s law and neither of them is “first and foremost a Chinese citizen” as claimed by China.
